Industrial Designs
An industrial design is the ornamental or aesthetic aspect of an article. The design may consist of three-dimensional features, such as the shape or surface of an article, or of two-dimensional features, such as patterns, lines or color.
Industrial designs are applied to a wide variety of products of industry and handicraft: from technical and medical instruments to watches, jewelry, and other luxury items; from housewares and electrical appliances to vehicles and architectural structures; from textile designs to leisure goods.

Filing Requirements
back to top- Full name and address of the applicant.
- Full name and address of inventor(s).
- The title of the design.
- A Certified copy of priority document(s), if claimed.
- A power of attorney, executed by the applicant, notarized and then legalized by the Iranian Consulate.
- If the priority is not in the name of the applicant, a deed of assignment, executed by parties, notarized and legalized by the Iranian Consulate.
- A set of description and drawings of design.
Goods and related International classification.
Opposition/Refusal
back to topIn case the application was refused, the applicant may appeal the refusal within 60 days with the Patent Office.
Publication
back to topThe grant of a design will be published once in the Official Gazette.
Beginning of protection
back to topFrom date of filing the application. If priority is claimed on the basis of foreign application, the priority rights are as prescribed by the Paris Convention.
Validity
back to topFive years from filing date.
Annuity/Renewal
back to topThe annuities should be paid on 5th anniversary of filing. Additional fees will apply if annuities are paid after the due dates. If annuities are not paid within six months after due dates, the design will be deemed withdrawn. Renewal is possible for two consecutive terms of 5 years.
Infringement – penalties
back to topinfringement and unfair competition cases of patents in Iran can be pursued According to the articles 28, 60 and 61 of Patents, Industrial Designs and Trademarks Registration Act of Islamic Republic of Iran.
Modification
back to topIt is likewise compulsory to record the change of name or address at the Registration Office. The required documents including:
- Certified and legalized Power of Attorney by the Iranian consulate.
- Certified and legalized copy of change of name or address document.
- Certificate of the granted Iranian design for endorsement.
Assignment
back to topit is compulsory to record assignments of each design at the Registration Office. The required documents are:
- Power of Attorney from the assignee, legalized up to the Iranian Consulate.
- Deed of assignment, signed by the assignor and assignee before a Notary Public and
- legalized up to the Iranian Consulate.
- Certificate of the granted Iranian design for endorsement.
Licenses
back to topThe owner of the design may grant a license of use of his design provided he records same at the Registration Office. The required documents including:
- The license agreement signed by both parties and legalized up to the Iranian Consulate.
- A Power of Attorney from the Licenser and Licensee, notarized and legalized by the Iranian consulate.
Nullification
back to topAny interested party may refer to the Tehran Court and apply for the cancellation of the Industrial Design, if the design is not a new and or original design, or that the registered owner of the design is not the creator or his successor in title.
